A man who claimed his life was destroyed when he got punched on the bum by a bread delivery man has failed to get any damages.
John Rice, 49, said he was injured when Alan Muddiman struck him at the Tesco in Blancharstown, Dublin, where he worked as a security guard.
Mr Rice, who claimed he had also been punched in the hip, has been off work since the incident in July 2009.
Mr Justice Kevin Cross dismissed the claim for damages against Mr Muddiman, from Leixlip, Co Kildare, at the High Court.
‘No doubt Mr Rice believed all his physical and psychological symptoms relate to the incident and what I have decided will be deeply disappointing to Mr Rice, who probably will believe to his grave that an injustice has occurred,’ he said.
Justice Cross made the decision after viewing CCTV images of the incident. He said these did not show a vicious blow to Mr Rice’s right buttock, the Irish Times reported.
The judge added he ‘should put matters behind him’, but that may be hard considering he has to pay legal costs after losing.
Mr Rice represented himself in court where he also claimed Mr Muddiman had punched him on the butt before.
He added their relationship had been one of ‘banter, high fives and back slapping’.
